Management Of The Panels Of Arbitrators

The following is a statement of the Board of Trustees Policy regarding the management of the Panels of Arbitrators maintained by the Centre.

1. The Trustees shall be responsible for the management of all Panels, both as to admission and removals.

2. Trustees may delegate management of the Panel to a Committee of Trustees but any disputes between an Applicant and a member of a Panel and the Centre will be determined by the Board of Trustees.

3. In applying this Policy it is recognized that the success and credibility of the Centre is directly dependent on the quality and abilities of Panel Members.

4. The size of any Panel will be determined from time to time, giving consideration to the number of arbitrations administered by the Centre, the opportunities for the Centre to make appointments and the importance of maintaining a diversity of specialization and geographic distribution of Panel Members.

5. A Trustee may sponsor an applicant for membership on a Panel but such will not ensure appointment.

6. It is recognized that the power to admit a person to a Panel is distinct from the appointment of an arbitrator under the Rules pursuant to a request from parties, which is the responsibility of the Executive Director.

7. The following general criteria shall be considered by the Trustees in approving admissions to a Panel:

    (a) Panel members will have the confidence of the Trustees as to their integrity and ability as arbitrators;

    (b) Panel members will have demonstrated skills and competence as arbitrators;

    (c) Panel members will have shown a commitment to the advancement and promotion of ADR and the BCICAC.
