Domain Island, Universal Registry, Supplemental Rules


 

  1. Definitions
    1. The Rules means the Universal Rules of Procedure of the Domain Island Registration Service
    2. The Supplemental Rules means these supplemental rules to the Universal Rules of Procedure.
    3. The Centre means the British Columbia International Commercial Arbitration Centre.
    4. Any terms used in these Supplemental Rules which are defined in the Universal Rules of Procedure, shall have the same meaning as in the Universal Rules of Procedure.
    5. The Policy means the Universal Dispute Policy.
    6. Calendar days, as referred to in the Rules, shall exclude weekends and statutory holidays.
  1. Scope

    The Centre will apply the Rules, the Policy and the Supplemental Rules in effect at the time that the Complaint is submitted. The Supplemental Rules may be amended by the Centre at its sole discretion.

  2. Communication with the Centre

    All communications with the Centre shall be by hard copy and in electronic form, directed to:

  3. The Complaint

The Complaint shall be sent to the Centre as outlined in Universal Rule 3 and as set out in the Notice of Complaint form attached (Appendix A). It shall not exceed ten (10) pages in total, not including supporting exhibits. The Complaint shall be accompanied by the appropriate fee (see Supplemental Rule 12).

The Centre shall notify the Respondent of the Complaint in accordance with Universal Rule 4, once the Complaint in proper form and fee have been received by the Centre.

5. The Response

The Response shall be sent to the Centre in the form outlined in Universal Rule 5 and as set out in the Notice of Response form attached (Appendix B)and shall not exceed ten (10) pages in total, not including supporting exhibits.

The Centre shall review the Response for administrative compliance with the Policy and the Rules and, if in compliance, shall forward the Response to the Complainant within 3 business days of its receipt by the Centre. If the Centre finds the Response to be administratively deficient it will promptly advise the Respondent which shall have 5 business days to correct such deficiencies.

Unless the Centre receives the response in the prescribed form, the Panel shall decide the dispute based upon the complaint (Universal Rule 5e), subject to the overall authority of the Panel to control the process.

6. Appointment of Panel and Timing of Decision

The Centre shall appoint the Panel in accordance with Universal Rule 6, within 5 business days following receipt of the Response as outlined in Supplemental Rule 5.

7. Impartiality and Independence

Prior to appointment as a Panelist, a candidate, upon accepting an appointment, shall sign a statement declaring that he or she knows of no circumstance likely to give rise to justifiable doubts as to his or her independence or impartiality and that he or she will disclose any such circumstance to the parties should such arise after that time and before the arbitration is concluded. A copy of the statement shall be filed with the Centre and a copy provided to all parties.

8. Communication Between Parties and the Panel

No party or anyone acting on its behalf may have direct communication with the Panel. Communications to the Centre shall be copied to all Parties.

9. General Powers of the Panel

The Panel shall have the authority to determine challenges to its jurisdiction and procedural challenges arising from the Rules or these Supplemental Rules.

Challenges to the impartiality, integrity or independence of a Panelist shall be determined by the Centre.

12. Fees

The following schedule of fees is in Canadian dollars:

For more than 10 names: the Centre will establish a fee taking into consideration the nature and complexity of the dispute.

Fees are payable at the time the complaint is filed with the Centre as follows:

  1. By certified check or money order in payable to the British Columbia International Commercial Arbitration Centre or
  2. By wire bank transfer to the account (no. 40-001-1691-901) of the British Columbia International Commercial Arbitration Centre, Bank of Montreal, 595 Burrard Street, Vancouver, BC, V7X 1L7 (phone 604-665-2726).

In the event of abandonment, withdrawal, or other termination of a proceeding prior to the appointment of a Panel, the Centre shall refund fees to the parties submitting them, except that it shall reserve an administrative processing fee of $500. No part of any fee shall be refunded after appointment of a Panel pursuant to Universal Rule 6.
