A Mediation?
The mediator assists parties to negotiate more effectively by:
- establishing the order of discussion;
- helping parties identify common ground;
- helping them get rid of irrelevancies or unproductive discussions;
- keeping the parties focused on the issues;
- moving parties from fixed positions;
- helping parties do "reality testing";
- encouraging compromise.
A Med-Arb?
The neutral
- assists the parties in the same way as at a mediation;
- if the parties are not able to settle the matter, the parties may then request the neutral to render a binding arbitral award.
An Arbitration?
The arbitrator
- will weigh and assess evidence presented to him or her by the parties;
- has the ability to call his or her own witnesses and to retain experts;
- cannot exclude evidence which a court would otherwise admit;
- will render an award based on the evidence presented and which is then legally binding on all parties to the dispute.
